The plaintiff is a 78-year-old woman who was the driver of a 1990 Dodge Omni equipped with a front seat single recliner mechanism. The plaintiff made a left turn in front of an oncoming vehicle. She was struck and as a result rear-ended a guardrail at a low delta-v. The plaintiff alleged that due to negligent design of her car seat, the seatback collapsed and she suffered a hyperextension of her thoracic spine, causing paraplegia.
