Obstetrical-Cerebral Palsy

A female was born with severe mental retardation when the defendant doctor neglected to diagnose metabolic acidosis and fetal distress during the late weeks of the mother's pregnancy. The plaintiff's mother contended that tests showed a growth retardation which should have been identified by the doctor and the infant should have been delivered by the due date instead of at forty-two weeks gestation, that the plaintiff would have been normal. The defendant doctor contended that the pregnancy was complicated because it was an abdominal pregnancy and abdominal pregnancies always have a bad outcome. Interest was added to the award which resulted in a total of about $6,000,000

Awarded: $2.75 Million
