Necessity for Second Back Surgery - Confidential

Plaintiff had far left lateral disk herniation at the L4/5 level impinging on the L4 nerve root. This was demonstrated by MRI, clinical symptoms and EMG. Plaintiff also had clinical symptoms of L5 nerve root impingement; however, this was not demonstrated on MRI. Defendant decompressed L5 nerve root, however, did not go out far left to decompress L4 which necessitated a second surgery, the cost of which with associated bills was $23,000. The second surgery to decompress the L4 nerve root was ultimately unsuccessful and laid down more surgical scarring which displaced the nerve root and caused intractable pain. Future medical treat- ment was claimed in the amount of$20,000 for pain medication.
