Gymnast suffers leg injuries as a result of head-on collision
Plaintiff was 17 year old high school senior who was injuredwhen Defendant crossed double yellow center line and struck her car head on.Plaintiff had prolonged extraction from her vehicle at the scene.She suffered a fracture of her right patella, right distal tibia and ankle with a badly comminuted pilon fracture with subluxation of the right foot and ankle.She has undergone a total of sixsurgeries so far, initially an open reduction and internal fixation of her right knee as well as open reduction and internal fixation of her right ankle joint and distal tibia, and then she later developed osteomyelitis posteriorly in the distal tibia which required debridement and extensive wound care.She had additional plastic surgery and skin grafting, removal of the hardware, and more recently a surgical procedure to release ligaments in her toes which were becoming deformed due to nerve damage.Due to a significant degenerative arthritis she will require ankle fusion within 3-4 years, and likely willneed a subtalar fusion as well in the future.
This injury was especially devastating to this Plaintiff, as at the time of the collisions she was a state champion gymnast with prospects of college scholarships in gymnastics and she had hoped to continue to compete in gymnastics at the college level.Orthopedist expert testified she will never be able to run, jump, dance, or even walk normally again because of this injury.
The primary carrier offered its limits of $100,000 early on; mediation with UIM carrier for additional $900,000 in coverage.Case settled for total of $875,000 from both carriers.
